February 20, 2002 - Kids Sue in Fatal Crash

Los Angeles - The children of Lora and Arthur Harper have filed a lawsuit against three motorists and a company whose truck dropped an insulation roll on Sierra Highway, causing a car to swerve into the path of Lora Harper's Honda. After the roll fell off, the truck driver stopped to retrieve it, but parked beside the highway and opened his door, narrowing the path for vehicles trying to miss the roll, the lawsuit says. "He retrieved the insulation after the wreck and then drove off," attorney R. Rex Parris said. "That's what witnesses tell us. We'll know for certain after we take his deposition." Parris said he believes the worker's boss sent the man back to the crash scene. Lora Harper, a registered nurse who worked for a firm that cares for invalids in their homes, died less than an hour after the Jan. 10 collision. Her husband, a Quail Valley School teacher, died after suffering a heart attack that night while telephoning family and friends to tell them of his wife's death. The wrongful-death lawsuit was filed last week in the Palmdale Courthouse on behalf of the Harpers' three children, college students Andrea and Dara and their younger brother, Clinton, a Lancaster Christian School student. The lawsuit does not specify the monetary damages it is seeking. The lawsuit also does not claim a monetary loss from Arthur Harper's death, but his death is cited in the document. The lawsuit names DeVore Insulation Co. of Lancaster and a DeVore employee who was driving the truck. DeVore's owner could not be reached Tuesday for comment. The lawsuit also names the Palmdale man who swerved around the insulation and hit Lora Harper's car head-on, as well as the Lancaster woman whose SUV was following Harper's car and hit it after the head-on collision. .
