March 28, 2001-Doctor says he was disabled by Posicor
Dr. Jimmy Frazier claimed Monday he was permanently disabled and unable to work after he took the drug Posicor to treat mild hypertension and congestive heart failure.
Frazier and his wife, Shirley, made the claim in a lawsuit filed in U.S. District Court in Dayton. Frazier took the medication March 27, 1998, was found "completely unresponsive" and taken to Good Samaritan Hospital, where he was diagnosed with acute pulmonary edema and respiratory failure, according to the lawsuit filed.
Frazier suffered "severe and debilitating damage to his heart" and has lost $ 1.2 million in income since he took the drug, the lawsuit states. The defendants in the lawsuit - Hoffman-LaRoche Inc. and Roche Group, both of Nutley, N.J. - confirmed the drug has been withdrawn from the market, but did not respond to other questions.
Roche Laboratories pulled Posicor off the market June 9, 1998, saying it may cause dangerous, even deadly, interactions with more than 25 other drugs, from antibiotics to cancer medicines.
The lawsuit, which seeks unspecified damages, claims the defendants "knew or should have known" that Posicor interacted dangerously with other medications and that before the Food and Drug Administration approved Posicor in 1997, data showed significant safety concerns about the drug.
Before it was removed from the market, Posicor caused multiple injuries and 24 deaths by interacting dangerously with other medications, according to the lawsuit.
